A disability rights group that brought a class-action lawsuit 11 years ago against the state Department of Public Instruction and Milwaukee Public Schools over the way MPS identified and served children with special needs lost ground earlier this year when a federal appeals court ruled in favor of the district.
That appeals court ruling threw out the class-certification from a lower court - indicating it was too broad - which granted what appeared to be a total victory for the district.
But Disability Rights Wisconsin hasn't given up.
The group has sought - and received - approval from U.S. District Court Judge Rudolph Randa to submit a discovery plan in an attempt to demonstrate that a viable class can be certified.
